For an electronic consignment record under the e-CMR Protocol, evidentiary value does not follow from its digital form alone. The record must be attributable to an entitled person, remain complete and unaltered in its final form, and show every permitted addition or change in a traceable way.

The Additional Protocol to the CMR Convention concerning the Electronic Consignment Note permits the consignment note and related declarations, instructions, requests and reservations to be issued electronically. A compliant electronic consignment note is equivalent to the paper note and has the same evidentiary value. This requires a reliable procedure, not merely a PDF file or an overwritten entry in an application.

This article deals only with electronic CMR records, authentication and the change log. The amount of liability, general signature law and the legal assessment of a paper consignment note are outside this guide.

Quick orientation

Is the electronic CMR record reliable evidence?

Classify the three points that should be checked first when authenticity and changes are disputed.

01 Question 1

What is the key issue at this stage?

Access, authentication and the original version must form one traceable record.

01

The access and role structure should be clarified before assessing the evidence.

Preserve who issued, approved, supplemented or accessed the consignment note. Record the relevant permissions, authentication method and access times. Without a reliable attribution, a digital record remains vulnerable even if its content appears complete.

02

The current display does not replace the preserved original version.

Check whether the change was permitted under the CMR and whether the system preserves the previous content. An addition or amendment must remain identifiable as such. Export the version history and related communication before further edits are made.

03

The record contains the main elements for a structured evidentiary review.

Keep the electronic consignment note, attachments, change history and documented procedures in one matter file. Also check that each entitled person can access the relevant particulars and that they remain available in a readable form.

What the e-CMR Protocol permits electronically

The Additional Protocol to the CMR Convention was adopted in Geneva on 20 February 2008 and entered into force on 5 June 2011. The United Nations Treaty Collection records Austria as a party from 6 August 2024. The Protocol supplements the CMR and is intended to facilitate the optional electronic issue and handling of the consignment note.

Electronic communication includes information generated, sent, received or stored by electronic, optical, digital or comparable means, provided that it remains accessible for later use. The electronic consignment note also includes particulars linked by attachments or another contemporaneous connection so that they become part of the electronic communication.

The electronic route may cover not only the note itself but also demands, declarations, instructions, requests, reservations and other communications relating to the carriage contract. The overview on CMR and the transport contract explains the wider contractual framework; this article focuses on the integrity of the electronic record.

How an electronic CMR record is authenticated

Article 3 of the Additional Protocol provides for authentication by a reliable electronic signature of the parties to the carriage contract. The signature must be linked to the electronic consignment note. A name typed into a text field is therefore not enough where the process cannot reliably connect the statement with the data set.

Reliability is presumed where the signature is uniquely linked to and identifies the signatory, is created with means under the signatory’s sole control, and is linked to the data so that a later change can be detected. The Protocol also permits another electronic authentication method allowed by the law of the country where the electronic consignment note was made out.

Companies should therefore record not only a user name, but also the role, the business represented, the authentication route and the connection with the particular consignment note. A shared driver password or a non-personal group account makes it difficult to establish who actually issued a statement.

What a reliable change log must show

Article 4 requires the electronic consignment note to contain the same particulars as the CMR note. The procedure must preserve the integrity of the particulars from the time they are first generated in final form. Complete and unaltered means that only additions or changes arising in the ordinary course of communication, storage and display are harmless.

Additions and amendments are permitted only in cases authorised by the CMR. The procedure must make every addition or amendment detectable as such and preserve the particulars originally contained. The current value must not replace the first version. A timestamp in a database is not enough if the previous content can no longer be retrieved.

A practical change log should include the original final version, old and new value, time, identified person or role, reason, related instruction or declaration and the version used for the carriage afterwards. This is a sound documentation structure, not a requirement to use a particular software product.

Secure access, attachments and readability

Under Article 3, the particulars in the electronic consignment note must be accessible to every party entitled to them. This may include the sender, carrier, consignee or another person involved in performing the carriage. Entitlement and actual access should be recorded separately so that later review can distinguish the two.

Attachments need particular care. Article 6 permits documents that already exist electronically to be supplied in that form when the parties have agreed procedures linking them to the electronic consignment note in a way that assures their integrity. A later attachment must not leave doubt about the version to which it belongs.

For the transport file, a readable export should show the note, attachments, versions, roles and times together. The raw record and system description should also be kept. A printout can illustrate the electronic original, but it does not by itself prove that the electronic version remained unchanged and accessible.

Which procedures the parties should agree first

Article 5 does not require one particular platform. It does require the parties to agree on procedures and their implementation so that the Protocol and the CMR are respected. The agreement should cover issue and delivery, integrity, proof of entitlement, confirmation of delivery, supplements and amendments, and a possible replacement by a note issued by other means.

Those procedures must be referred to in the electronic consignment note and be readily ascertainable. The agreement should therefore identify not only the service provider, but also the relevant version, roles, authentication, export, retention, outage handling and treatment of corrections. The description must match the actual process.

An amendment following an authorised instruction is different from a technical correction of a typing error. The first must be linked to the instruction; the second must preserve the original entry and identify the technical correction. Neither should be hidden in an unexplained overwrite.

How evidentiary value is assessed in a dispute

Article 2 gives a compliant electronic consignment note the same evidentiary value and effects as the CMR consignment note. A dispute will nevertheless concern more than the current screen. The party relying on the record should be able to explain its creation, access and amendments and connect them with the remaining transport documents.

Preserve the electronic note at the relevant time, the identity of the people acting, the agreed procedures, access and delivery events, attachments and related messages. For a reservation, it should be possible to identify who made it, when, for which shipment and whether a later supplement or amendment followed.

The guidance on signatures and reservations on the CMR consignment note adds the delivery perspective. After a cargo incident, preserving evidence of cargo damage complements the electronic record with photographs, condition reports and other proof.

Where the electronic record has limits

The e-CMR Protocol permits electronic procedures but does not answer every factual or contractual question. It prescribes no single program, file type or technical architecture. Conversely, a digital display is not enough where authentication, access, integrity or the change history cannot be reconstructed.

The possibility of replacing the electronic note should also be agreed in advance. Article 5 expressly mentions procedures for a possible replacement by a note issued by different means. In an outage, loss of access or change of carrier, the parties should document which version remains authoritative and how the connection between versions is preserved.

When records are exported, the export should not be the only safeguard. Keep the electronic original, its versions and the procedure description separately from the printout. This helps show that the readable evidence came from a complete and traceable record.

Which records should be preserved now

First preserve the electronic consignment note in its final form and every linked attachment. Add the shipment number, businesses involved, user roles, creation and amendment times and the version that applied at delivery.

Then check whether every change remains identifiable, whether the earlier value is preserved and whether the underlying instruction or declaration can be retrieved. Compare the data set with the order, delivery note, proof of delivery and messages. Record contradictions as open issues instead of hiding them through a further edit.

If a complaint has been rejected, a digital correction is disputed or the system has changed, the complete transport file should be organised for legal review. This makes it possible to assess whether the electronic consignment note meets the Protocol and what the change history actually proves.

Practical questions

Frequently asked questions about electronic CMR

Does an electronic CMR consignment note have the same evidentiary value as a paper note? +
Yes, if it complies with the Additional Protocol. Article 2 treats a compliant electronic consignment note as equivalent to the CMR note and gives it the same evidentiary value and effects.
Can an electronic consignment note be amended later? +
Additions and amendments are permitted only in cases authorised by the CMR. The procedure must make the change detectable and preserve the original particulars. An unexplained overwrite is not sufficient.
What should a change log contain? +
A sound structure includes the original final version, old and new value, time, acting person or role, reason, related instruction or declaration and the version used afterwards. The Protocol does not require a particular software product, but it does require detectable changes and preserved originals.
Is a PDF printout enough evidence? +
A PDF can present the content in readable form. The electronic original, versions, authentication, access and agreed procedures should also be preserved because a printout alone does not show the creation and amendment history.
